In the July 27 meeting of the Planning Advisory Committee (PAC)stakeholders were invited to submit feedback on the proposed Tariff language revisions to Attachment EE to Permit Additional Transmission Planning Consultations.

ITC appreciates the opportunity to support the proposed changes to update the tariff provisions in Attachment EE used to allow Authorized Requestors transmission planning information with appropriate NDA protections. When changes were made in 2021, it appears that a drafting oversight created the unintended consequence of prevented discussions between Authorized Requestors working for different entities depending on how they had executed their NDAs. Allowing consultations among Authorized Requestors from different entities is reasonable if both have executed NDAs and thus are authorized to received identical access to that transmission planning information and data.
ITC supports the proposed changes discussed at the June PAC and the further refinements, as discussed in the July PAC presentation, which correct the definition of Authorized Agency in Attachment EE to agree with Tariff definition and will include a reference to the appropriate use of data when eliminating the additional notice requirement. Access to and consultations about transmission planning information, with the appropriate NDA protections, is an important aspect of MISO’s open and transparent planning process.
